Product liability cases often affect multiple people and become grounds for class action lawsuits. When a consumer is hurt by a product, several entities may be responsible. Determining who is responsible is key to knowing what kind of product liability suit to file.
The inventor of a product may have simply designed a product that is not safe. For example, a specific model of SUV may have repeated roll-over accidents, or a model of a gun may fire when no one has pulled the trigger.
The product’s design may be fine in some cases, but the manufacturer may have been negligent. For example, you would sue the manufacturer if a piece of equipment was missing a critical safety feature or if you got botulism from a certain type of canned or jarred food.
A marketing company might be considered negligent as well. If a company failed to tell you how to use their products safely or did not warn you of the product’s side effects, you might have a product liability lawsuit.
