Were you under the influence or not? With an AZ DUI, it doesn’t matter; with an AZ DWI it does. With an Arizona DUI, you can be arrested and charged even if your breathalyzer or blood test results are under 0.08, or even at zero.

On the contrary, you can only be charged with a DWI if your breathalyzer and/or blood test results showed a BAC of at least 0.08 or higher.
