This comes up enough that it deserves mentioning to all of my our friends - MAKE SURE YOU HAVE SUFFICIENT UNINSURED/UNDERINSURED MOTORIST (UM) COVERAGE! Why? Because if you are hit by someone who has insufficient or no coverage and no assets, you may be up chocolate creek without a pop-sickle stick, paying your own medical expenses and eating the cost of your lost income. This doesn't mean that your attorney won't have to fight your own insurance provider to get you compensated since certain providers will still do everything they can to deny your claim, but at least you are in a much better situation than if you only have $25,000 in UM coverage. I'm dealing with one right now, let's call them "Lima Mike Insurance", who is doing their best to avoid paying my client/their insured despite clear fault of the other driver. So, before you consider settling your claim on your own, consider that your insurer knows the law and their policy better than you do and will use this knowledge to their benefit.
