Another recent BC Appeal Court decision confirmed that children and spouses of a deceased can apply to vary the Will of the deceased after the death if unhappy with the amount of their inheritance compared to the other beneficiaries.
An application to vary is different than asking the court to interpet the words used by the deceased. A variation application is asking the court to critique the fairness of the bequests. This right of variation is limited to children and spouses of the deceased - so note if anyone you know was not legally adopted by the deceased.
