Most people are happy not to be chosen to be the executor of an estate because of the year or two of administrative duties and legal obligations. We have more than 30 years of experience helping thousands of different people so we can help you too.
The duties of an Estate Executor is the representative of the deceased, "standing in the shoes" of the deceased. An Executor has the responsibility to find, identify and secure all of the assets & debts of the deceased, then pay all legitimate debts (so need to investigate not just pay everyone asking) including income taxes so the Executor must complete and file with CRA the final tax return of the deceased.
Before giving away the residue of the estate to any beneficiaries, the Executor should post a Notice to Creditors, and obtain a Clearance Certificate otherwise the Executor can be liable for unpaid debts and taxes. The Executor should also obtain a Release from anyone receiving a payment from the estate.
Since the duties of an Executor can take more than a year before completing everything properly, the Court's have a custom of not hearing any complaint by a beneficiary that they have not yet received their inheritance.
