Damages in Personal Injury Cases: Past and Future Medicals


This is the most common area of damages in a personal injury case and it is what defense attorneys and claims adjusters tend to focus on more than anything because they are often the most tangible damages in an injury case.

Past medical damages is the money owed to a person that is the reasonable value of the medical treatment they received as a result of the incident. Generally speaking, this amount of damages is calculated by looking at the total medical bills a person has incurred due to the injuries they received as a result of another person hurting them.

Future medical damages is money owed to a person for physical injuries for all of the medical treatment they will need in the future to address the permanent effect of those injuries.

To prove these damages, an attorney must prove the reasonableness and necessity of the medical expenses incurred. This means a person must prove that the injuries they received were a result of the incident, that the medical treatment they received for those injuries was related to the incident, and that the medical treatment was necessary and reasonable. For future damages you will need to prove that it is reasonably certain that the bills will be incurred, i.e., a doctor will need to say you will have to have treatment in the future to address your injuries.
