Pedestrian accidents are on the rise. A recent report from the Governors Highway Safety Association showed that pedestrian deaths have reached a 40-year high. Why? Bigger SUVs and more distracted drivers looking at phones.
If you are hit by a car while walking, the injuries are often catastrophic. We have helped many families where a child was hit in a crosswalk or a parent was hit in a parking lot.
The driver might say, "I didn't see them." That is not a defense. Drivers have a duty to scan the road and watch for people. If they were texting or speeding, they are responsible for the damage they caused.
