Can You Expunge a Felony? The Rules You Need to Know
Facing a felony charge can feel permanent. As a criminal lawyer, I’m often asked: "Can you expunge a felony?" In Nevada, we use "sealing" criminal records, not expungement. It offers a fresh start, but rules apply.
Not all felonies can be sealed. Sex offenses, child abuse, and felony DUIs causing substantial bodily harm are typically ineligible. For eligible felonies, strict waiting periods are crucial. A Category E felony usually requires 2 years. More serious felonies (Categories B, C, D) demand 5 to 10 years from case closure.
This process is vital. Twenty-seven percent of formerly incarcerated persons are unemployed, often due to criminal records. Sealing your record can restore rights and open doors to jobs and housing. Don't let a past mistake define your future.
