Terms and Conditions1. Scope of Works
The works covered by this offer are limited strictly to the construction of the retaining wall(s) as described in the quotation. Any additional works, variations, or changes requested by the client will be subject to a separate written agreement and may incur additional costs.
2. Design Responsibility
Unless explicitly stated otherwise, this quotation is based on construction only. Structural design, engineering calculations, soil reports, and approvals are the responsibility of the client. Any works carried out are assumed to be in accordance with approved drawings and specifications provided.
3. Ground Conditions
The quotation is based on assumed ground conditions. Any unforeseen ground conditions, including but not limited to rock, excessive water, unstable ground, or obstructions, may result in additional costs and/or delays.
4. Foundations and Drainage
Retaining wall performance is dependent on adequate foundations and drainage. The contractor will install drainage measures as specified in the quotation; however, responsibility for overall site drainage outside the scope of works remains with the client unless otherwise agreed in writing.
5. Access and Site Conditions
The client is responsible for providing clear, safe, and unrestricted access to the site during working hours. Any delays or additional costs arising from restricted access, site constraints, or third-party interference will be charged accordingly.
6. Materials
All materials used will be of standard industry quality unless otherwise specified. Natural materials such as stone may vary in color, size, and appearance, which is considered acceptable and not a defect.
7. Programme and Delays
Any estimated start or completion dates are indicative only and may be affected by weather conditions, ground conditions, material availability, or other circumstances beyond the contractor’s control.
8. Payment Terms
Payment terms are as stated in the quotation. Failure to make payments in accordance with agreed terms may result in suspension of works until payment is received.
9. Health and Safety
All works will be carried out in compliance with applicable health and safety regulations. The client must ensure the site remains safe and free from hazards not related to the contracted works.
10. Warranty and Liability
The contractor warrants workmanship for a period stated in the quotation, subject to normal use and maintenance. No liability is accepted for movement, cracking, or failure caused by ground movement, water pressure, changes in loading, or works carried out by others.
11. Damage and Existing Structures
The contractor is not responsible for damage to existing underground services, structures, or boundaries unless their presence has been clearly identified prior to commencement.
12. Cancellations
If the client cancels the works after acceptance of the quotation, the contractor reserves the right to recover costs incurred for materials, labor, and preparation.
13. Dispute Resolution
Any disputes arising from this agreement should be resolved through mutual discussion in the first instance. If unresolved, disputes shall be subject to the applicable laws governing the contract.
