Arizona HOA laws just changed in a big way. Three new protections took effect this week that limit what your association can actually do to you.
First: your HOA cannot block you from installing shade structures anymore. Gazebos, umbrellas, canopies. They're protected now. Second: they can't foreclose on your home unless you owe more than $10,000 in assessments. The old limit was just $1,200. Third: boards now have a legal duty to act without favoritism when they make decisions on architecture or landscaping.
Phoenix attorney Jonathan Dessaules says the real problem isn't the assessments. It's the excessive collection fees that drive people to foreclosure. And those aren't addressed in these laws yet. But this is a start. Homeowners finally have some legal ground to stand on.
