Divorce MATRIMONIAL: Financial remedy agreement not influenced by reasons for divorce
Brighton's Family Court has ruled that the GBP160,000 cost of a husband's gender reassignment surgery should be met from the divorcing couple's matrimonial assets. The couple spent nearly GBP1 million in legal fees disputing how to divide the GBP3 million asset pot, with the wife arguing that the cost of surgery should be borne solely by the husband because it was the reason for the divorce petition. Ultimately, the court followed the principle that a financial remedy should not normally be influenced by the reasons for marital breakdown (JY v KF, 2025 EWFC 195 B).
