But did you know these constitutional rights must be asserted? That means if you are being questioned by law enforcement, you must stay silent and/or say out loud "I would like an attorney." If neither of these things are done at the time of questioning, and law enforcement has advised you of your rights (known as a Miranda warning), then you have waived these rights until you assert them.
