Today, May 10, marks the two-year anniversary of Governor Kemp signing the Georgia Hemp Farming Act into law. The unanticipated result of that law was that possession of marijuana cases became much more difficult to prove. Now, the State of Georgia must prove that suspected marijuana is not hemp. Previously, a simple test by law enforcement could provide that result. Now, the GBI must test it (and the GBI apparently isn’t testing anything but felony amounts of leaf marijuana). Has that stopped some police departments from making misdemeanor marijuana arrests? No. Has that stopped some prosecutors from prosecuting misdemeanor marijuana cases? No.
