When you bring a divorce action against your spouse, you must inform them of the proceedings and provide them with a copy of the court filings. You are not allowed to serve these documents on your spouse. A uninvolved third party, such as a family member, sheriff, or professional process server, must serve the documents.
Your process server must serve papers on time, fill out a proof of service form, and return the proof of service form to the court. If they fail to meet these requirements, your spouse could claim they were served improperly. Read on to learn more.
