WHAT IS THE NEW CALIFORNIA LEMON LAW ABOUT?
Starting in January 2025, California’s lemon law was updated under AB 1755. However, these changes do not apply to every manufacturer—they only apply to those that have chosen to opt in and follow the new procedures.
Some of these manufacturers that have opted in include:
· Ford Motor Company
· General Motors
· Jeep, Dodge, Chrysler, Ram (FCA)
· Hyundai
· Kia
· Mercedes-Benz
· Jaguar Land Rover
· Maserati
· Nissan
Some of the major changes under AB 1755 include a more structured and expedited litigation process (once the case is filed with the
court):
· Early Exchange of core documents (Automatic Initial Disclosures)
· Plaintiff deposition must be offered quickly
· Manufacturer Person Most Qualified Deposition limited to typically two hours
· Mandatory early mediation window
· Civil Penalty Framework Gets More Structured
· Imposes a hard 6-year limit from original date of when vehicle was sold or leased
· Ab 1755 also applies to used vehicles (Certified Pre-owned)
